1.0. This Membership Agreement sets forth the terms and conditions of membership in the TRINITY HOT SPRINGS CLUB, owned Trinity Holdings LLC, operated by Trinity Hot Springs, LLC dba Trinity Hot Springs (“Trinity Hot Springs”). These terms and conditions are binding on those individuals who are members of the Club (each a “Member”).

1.1 Vision Statement. The Trinity Hot Springs Club is a membership based community that has come together in the spirit of stewardship to honor and enjoy the unique natural resources that includes Trinity Hot Springs, one of the deepest and purest known sources of spring water in the world. Respect is practiced and demonstrated collectively as a community including respect for ourselves, each other, the property, the land, the water, and resources on site.

1.2. Tolerance is practiced and celebrated as we do not discriminate based on race, religion, sexual orientation or social status. Membership may be revoked at any time due to disrespectful behavior towards any Member, guest or staff member, or the Trinity Hot Springs resources.

2.0. Membership. In exchange for payment of membership dues in the amount indicated on the Trinity Hot Springs Front Desk Online System, members will have use of Trinity Hot Springs Club facilities in accordance with the terms and conditions contained in this Membership Agreement. Club membership dues are paid monthly or in pre-purchased packages. Membership can be cancelled at any time. Trinity Hot Springs and its agents and/or managers may suspend or terminate your membership at any time and for any reason.

2.1. Membership Privileges. In exchange for payment of Trinity Hot Springs Club membership dues and compliance with the Rules that form part of this Membership Agreement, Trinity Hot Springs Club Members are entitled to:

– Access to the club grounds, picnic areas, changing rooms, and clubhouse including fitness studio and a lounge area on a first come basis during open hours or by reservation.

– Online access to the Trinity Hot Springs Reservation System for lodging, soaking, spa, and classes.

– Discounts periodically on classes, special events, programs, and products.

– Invitations to Members only events, and online access to Member forums.

2.2. Guest Memberships. Temporary membership for lodging guests and event guests, and guests of a Member (“Guests”) may be granted by management. Guest membership must be connected at all times to a current active Member. ALL Guests must sign the ‘Trinity Hot Springs Waiver of Liability’ and agree to and comply with the Rules and Regulations. Guest Members are entitled to:

– Access to the club grounds, picnic area, changing rooms, and clubhouse including fitness studio and a common area on a first come basis during open hours or by reservation.

– Staff Scheduled Reservations for soaking, spa, and classes.

3.0. Limitations on Access. Access to the club grounds, pool area, picnic area, changing rooms, and clubhouse including fitness studio and Lounge may be limited or unavailable, even during open hours, at any time without notice. Closure notices will typically be posted on the website in advance. Trinity Hot Springs Club membership and Guest membership does NOT include access to the Paradise Lodge, which may, at times, be made available to club members as an occasional added benefit.

4.0. Right to Terminate Membership. Either the Member or Trinity Hot Springs may terminate this Membership Agreement at any time and for any reason. Upon termination, the Member will be entitled to receive a prorated refund for any unused remaining balance on account. However, this may exclude refunds for terminated membership due to violation of the Rules and/or breach of this Membership Agreement.

5.0. Club Rules. As a Member, you agree that you, together with all persons using the facilities through your membership, are bound by and will comply with the Rules of the Trinity Hot Springs Club as they are amended or supplemented from time to time, such Rules being attached to this Membership Agreement.

 

6.0. WAIVER OF LIABILITY.

6.1. In consideration of the membership rights granted in this Membership Agreement, you accept the resort and Club facilities and services “as is” and agree that all use of the services and facilities is undertaken at your sole risk.

6.2. You understand that the activities natural to the use of a hot spring pool, fitness equipment, and fitness and wellness activities involve an inherent risk and you agree that Trinity Hot Springs, including its owners and representatives, shall not be held in any way liable for any injuries or damage to you or your property, or that of your family or guests, arising out of the use of the Trinity Hot Spring Club’s services or facilities, whether or not resulting from acts of active or passive negligence on the part of Trinity Hot Springs, it’s owners, employees, staff or agents.

6.3. You are solely responsible for consulting with your doctor about any conditions you have (especially if you have a pacemaker or heart disease or are pregnant) and/or medications you are taking to confirm if any activities that you might choose to participate in onsite such as hot spring soaking, yoga classes, aqua aerobics, etc. are not recommended.

6.4. You understand that the activities onsite, including soaking in hot water, can cause intense relaxation and could influence motor skills. During your time onsite and when you leave the premises you take full responsibility for your actions.

6.5. You further understand and agree that Trinity Hot Springs shall not be responsible for any of your personal property, or the property of your family or Guests, which may be lost or stolen while on the premises.

6.6. By using the Trinity Hot Springs facilities, you unconditionally waive, release, and agree to hold harmless Trinity Hot Springs, and it’s owners, employees, staff and agents from any and all liability, claims, demands and causes of action whatsoever, arising out of or related to any loss, damage or injury, including death, that may be sustained by you while on the premises in connection with use of Trinity Hot Springs Club facilities.

6.7. You understand the statements above, and completely and voluntarily assume all risks. You understand this is a legally binding agreement which releases Trinity Hot Springs of liability and that you are releasing any right to make a clam or file a lawsuit against any released party.

7.0. Agreement. By signing or acknowledging the Membership Agreement, you confirm that you have read and understand this Membership Agreement in its entirety. This Membership Agreement constitutes the full agreement between you and Trinity Hot Springs. This Membership Agreement and any action arising from any use of the facilities pursuant to the right granted in this Membership Agreement shall be governed by the laws of the State of Idaho.

8.0. Signature. If signing online, by checking the box marked “I accept”, you are electronically signing the Trinity Hot Springs Membership Agreement, which expressly includes the Waiver of Liability, and agreeing to the terms, Rules and policies contained herein. Your electronic signature has the same legal effect as a hand written signature.

 

9.0. HOURS OF OPERATION (Always Check Website for Updates)

Club Member Pool Hours: Monday – Thursday 9am – 9pm Friday – Sunday 9am – 11pm

Office Hours:
Monday and Wed 12 noon to 6 pm, Friday & Saturday 3pm – 6pm.

Staff may be available other times by reservation.

 

10.0 GENERAL TRINITY HOT SPRINGS CLUB RULES

10.1. Members may be required to show legal identification at any time.

10.2. There is NO LIFEGUARD on duty! Members and their Guests use the pool and facilities at their own risk.

10.3. Any children under the age of 13 must be supervised by an adult at all times. No person of any age shall soak alone.

10.4. All children under the age of 4 and any who are not yet toilet trained must use approved swim diapers.

10.5. Anyone with infectious or contagious disease, open sores/wounds, a fever over 99 degrees or an infectious condition must not enter the pool.

10.6. The hot spring pool is a natural geothermal soaking pool, and is operated without artificial additives, treatments, or alterations of any kind. Members and their Guests will not drop, add, nor bring any contaminants near the pool.

10.7. There shall be NO diving, running, pushing, or horseplay inside the fenced pool area.

10.8. There shall be NO inconsiderate language, loud noise, or disruptive behavior on the premises.

10.9. There shall be NO bicycles, scooters, roller skates/ roller blades, skateboards, or other wheeled transportation / recreation permitted inside the fenced in pool area.

10.10. There shall be NO glass or porcelain containers inside the fenced in pool area. All containers must be non-breakable. NO EXCEPTIONS!

10.11. Excessive drinking of alcohol, and/or public intoxication is not permitted and will result in eviction from the facilities and possible suspension of membership.

10.12. All Members and their Guests will ASSUME TOTAL responsibility for any incidents or accidents that involve the consumption of alcohol, in any amount, and they will NOT hold Trinity Hot Springs Club and it’s owners and or agents responsible or liable for any damages in the case of injury and may be held financially responsible for any damages done to the property or others in any such incident.

10.13. Smoking is permitted in designated areas only. There shall be NO smoking or chewing tobacco inside the fenced pool area. All buildings (including 20 feet from every door), campgrounds, and all parking lots on the resort property are a Smoke Free Environment. Designated smoking areas are provided.

10.14. No pets are allowed inside the fenced in pool area. Pets outside the fenced in pool area must be on a leash or contained. All pet waste must be picked up and removed from the premises.

10.15. The pool area fence gates must be closed and never be propped open.

10.16. No illegal substances or business dealings are permitted on the premises.

10.17. No guns, knives, or weapons of any kind are permitted on the premises.

10.18. Respect for all shall be practiced on the premises.
